Terms & Conditions

LEGAL DISCLAMER

The Terms of Service (“Terms”), along with the Privacy Policy, governs your use of the application and website provided by NABI Health Private Limited (“NABI, our, us, we”). NABI is a company incorporated under the laws of India, with its registered office at Tower B, Asian Sun City, Kondapur, Hyderabad, Telangana - 500084. These Terms constitute an agreement between you and NABI and comprehensively define your rights and obligations regarding using our services. You must be aged 18 years or older to use our services. If you are under 18, please contact us, as we will require your parent or legal guardian to consent on your behalf. Any violation of these Terms allows us to restrict or remove access to our services based on our discretion. Please carefully read these Terms and the Privacy Policy before using our services.

USE OF OUR SERVICE

We provide emotional well-being support and preventive services through volunteers, support mechanisms for self-reflection, and other online tools (such as machine learning) (“Services”). By agreeing to these Terms, you understand that:

1. Our Services are provided for your personal and non-commercial use. You acknowledge that our Services are not intended to substitute medical care, including any emergency care.

2. As all our Services are confidential and specific to your interactions with us, you will use the support we provide for your purposes only. Any advice provided to you must not be shared with any third party.

3. You agree to use our Services only following applicable laws, these Terms and the Privacy Policy. In particular, you agree not to upload any content or share any information that:
a) belongs to another person and to which you do have any right; is obscene, pornographic, paedophilic, invasive of another’s privacy, including bodily privacy, insulting or harassing based on gender, racially or ethnically objectionable, relating or encouraging money laundering or gambling, or promoting enmity between different groups on the grounds of religion or caste with the intent to incite violence;
b) is harmful to a child;
c) infringes any patent, trademark, copyright or other proprietary rights;
d) deceives or misleads the addressee about the origin of the message or knowingly and intentionally communicates any misinformation or information that is patently false and untrue or misleading;
e) impersonates another person;
f) threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States, or public order, or causes incitement to the commission of any cognisable offence, or prevents investigation of any offence, or is insulting other nation;
g) contains software virus or any other computer code, file or program designed to interrupt, destroy or limit the functionality of any computer resource.

4. You agree only to provide accurate and complete information about your mental and emotional conditions to help us provide our Services to you.

5. You agree that only you will use our Services through your registered account and will not allow any third party to access your account.

6. We may use third-party support services and partners to help provide our Services. We strongly suggest reading any internal policies of third parties if you continue to interact with such support services and partners.

7. By providing us with your contact details, you agree for us to contact you, including through third-party support services, for any purposes relating to using our Services.

8. If you are not a resident of India:
a) If you are from the European Union, you will benefit from any mandatory provision of law based on the country you reside in.
b) If you are from the United States, you represent that you are not listed on any United States government lists of prohibited or restricted parties.

CANCELLATION AND REFUND POLICY

1. Any cancellations made up to 6 hours before the appointment will receive a 100% refund. Processing refunds may take 7-10 business days.

2. Rescheduling is permitted up to 6 hours before the appointment. You can cancel and reschedule for the total amount any time closer to the appointment.

3. No refunds will be issued if you fail to attend the appointment. If you join the appointment 15 minutes late, no refund will be issued.

LIMITATION OF LIABILITY AND DISCLAIMERS

1. We will take all reasonable care to provide our Services to you. While we cannot ensure that our Services will remain constantly available, we will make every effort to provide you with consistent and uninterrupted Services.

2. To the extent permitted by law, we will not be liable for any damage or loss you suffer through our Services. Our liability for negligence, breaches of contract, and other legal contraventions, as may be legally permitted, will be limited to reinstating our Services or INR 20000.

3. We are not liable for the availability, services, or any loss/inconvenience caused by third-party partners and support services whose links are provided through our Services, including payment service providers.

4. Any content on our website, including informative, promotional or support-reading materials, is provided “as-is”. We are not responsible for any decision you undertake based on these materials.

5. Unless otherwise stated, any information provided through our Services is provided on an “as is” basis, without any kind of warranty.

CHANGES TO TERMS

We will notify you of any material changes to these Terms. You should check this page periodically to ensure you are updated on any non-material changes to the Terms (and the Privacy Policy) and if you are happy with those changes. If any provision of these Terms is held to be illegal or unenforceable for any reason, do note that the remaining provisions shall remain in full effect.

GOVERNING LAW

These Terms, including any disputes concerning our Services, will be governed by the laws of India and the exclusive jurisdiction of the courts of Hyderabad, Telangana.
